DUI Attorney Virginia Interlock Law

Beginning July 1 2012, in Virginia everyone convicted of DUI will have to have ignition interlocks installed in their vehicles. Currently, that requirement applies only to repeat offenders.

Ignition interlocks are much like in-vehicle Breathalyzers. The offender must blow into the device, and if it senses that the driver's blood alcohol is above a certain specified threshold, the engine will not start. Most devices have fraud protections in place to ensure that the offender does not simply have another person blow into the device for them.

The new law requires that offenders provide the court with proof that the device has been installed within 30 days of the court order. If the offender failed to install the system on time, or to have the device properly monitored and calibrated, the court can revoke the offender's driving privileges. The offender must cover all expenses associated with the installation and maintenance of the device, and this can be expensive.
